How to Verify A Registered Taiwan Trademark Agent
Choosing the Right Agent Is the First Step to Brand Protection.
Background:
From a Free Market to a Regulated System
For years, trademark applications in Taiwan have been handled by lawyers, patent attorneys, or experienced trademark agents. However, due to the lack of a clear legal framework, unqualified service providers emerged—some with little to no trademark knowledge—leading to errors, improper filings, and legal risks for brand owners.
The IP community had long called for a formal registration system. With the new system in place, Taiwan has entered a new era of professionalized brand rights management.
Who Can Register as a Taiwan Trademark Agent?
The registration system is governed by the “Regulations for the Registration and Management of Trademark Agents,” implemented by the Taiwan Intellectual Property Office (TIPO) starting August 2023. Individuals who meet one of the following criteria may apply:
Legal Basis For Trademark Agent Registration
Applicants must meet one of the following conditions to register as a trademark agent:
- Licensed lawyer or certified public accountant (CPA)
- Passed all subjects of the official Trademark Professional Competency Certification Exam and obtained the certificate
- Worked for over 10 years at a trademark authority handling examination of applications, oppositions, invalidations, and revocations as defined in Article 14 of the Trademark Act, with excellent performance and documented proof
- Engaged in continuous trademark agent practice in the 3 years prior to the amended Trademark Act coming into force (May 1, 2024), handling 10 or more trademark cases annually. Eligible to register within 1 year from the effective date
Once registered, agents are issued an official certificate and a unique registration number (e.g., TT000487), which can be verified through TIPO’s public online database.
